Terms of use

General

The following terms of participation apply to the use of the AnyIdea platform, available under the domain anyidea.ai and for participation in campaigns and challenges (hereinafter referred to as “campaigns”) organized by AnyIdea and customers of AnyIdea (hereinafter referred to as “Operator”). By registering on the platform, each participant (hereinafter referred to as “user”) expressly and bindingly accepts these general conditions of participation.

It is pointed out that each campaign may also have special participation conditions, which are expressly and bindingly agreed to by participating in the campaign.

Platform

Registration allows users to participate in campaigns, send in ideas, approaches and suggested solutions (hereinafter referred to as “content”) or make comments. The campaigns take place on the AnyIdea platform. As a user, you have the opportunity to communicate with other users and to interact in campaigns, e.g. through likes.

Interaction and communication

The platform offers comment functions and other interactive options that allow users to share comments with other users on the platform. Depending on the campaign type (private, hybrid with access request, public), public or users participating in the campaign, a comment is visible. Messages between users (private comments) are private and are not publicly available. The operators assume no responsibility or liability in this regard. Furthermore, operators reserve the right to remove offensive or insulting comments from the platform.

Links to other websites

The platform contains links to other websites. AnyIdea is not responsible for the content, privacy policies, or other terms of other websites. If you visit a website linked to AnyIdea, please inform yourself about the regulations and usage instructions applicable there.

Participation, account and account

Users must first register and accept the terms of participation before they can participate in campaigns and submit content.

Users can participate in campaigns via email to service@anyidea.ai End anytime. If you also wish to delete the account and personal data, this must be stated in the e-mail - with the “Request to delete account and data”. Rights and obligations that arose before the date of termination and deletion remain unaffected by termination and deletion of the account.

Depending on the specific participation conditions for campaigns, submitted ideas are not affected by the deletion and remain with the operator.

Users are not allowed to reuse trademarks or service marks used on the platform as a result of participating in the competition.

Code of conduct

Information and conditions can be found in the details of each campaign. The following rules apply to all campaigns, which must be observed at all times. If this is not done, the operator reserves the right to exclude users from campaigns, to delete individual content or an entire user account from the platform. For example, when content...

• contains inappropriate, obscene, defamatory, vulgar, illegal, or otherwise indecent content,
• infringe intellectual property rights, misappropriate trade secrets or contain confidential information from third parties,
• includes “hate speech” or includes discrimination based on race, sex, religion, national origin, religious affiliation, or sexual orientation;
• contain suspicious or harmful files, such as viruses, worms, damaged files, cracks or other suspicious content, which may damage the AnyIdea platform or other software or hardware or violate AnyIdea security measures or third parties,
• promote or facilitate illegal activity,
• contain confidential information about trade secrets of other active users.

AnyIdea is neither responsible for the content nor responsible for the consequences of content on the platform.

If two pieces of the same or very similar content are submitted, the content submitted first is generally accepted. Whether content is judged to be similar is at the sole discretion of operators.

Content that is incomplete, damaged, or unrecognizable may be invalidated and deleted.

When registering with AnyIdea, the user agrees to the general participation conditions, terms of use and rules of conduct and when participating in a campaign, at the latest by submitting content for such a campaign, to the special conditions of participation. Failure to comply can result in the exclusion of campaigns, data deletion or account deletion.

Users also agree to accept and comply with the decisions made by operators, which are final and binding.

Operators make every effort to provide individual feedback on submitted content, but are not obliged to do so. Users are not entitled to an explanation or detailed information regarding the evaluations, assessment, evaluation and decisions made by and about content submitted by users by operators.

Operators are generally not required to receive and respond to any correspondence from users.

Prize claim

Ideas have the opportunity to be honored and recognized as winners in accordance with the information in the respective campaign.

A team of experts and operators evaluates the submitted ideas according to defined criteria and determines the best submissions. Evaluations of individual ideas based on the evaluation criteria are not published. Users are not entitled to individual feedback or an explanation of the decision from experts and operators. An appeal against the decision of the operators is inadmissible. Legal recourse is excluded.

You will be contacted by the operator after the profit has been announced. A prize claim expires if the winner is unable to be reached twice, if the winner does not respond or if the winner does not accept the prize, regardless of the cause, 30 days after the first email has been sent. After the deadline, Operator reserves the right to appoint a new winner and award the prize to that person.

Notifications

When you log in to the AnyIdea platform, you provide your email address as a user. You will be informed by e-mail, including the points listed below:

• promote or facilitate illegal activity,
• launching new campaigns,
• updates and information about ongoing campaigns,
• Interactions such as likes, comments on ideas you have submitted,
• results of completed campaigns,
• notification of a potential win,
• platform news and information, updates and features,
• AnyIdea news.

You hereby agree that AnyIdea may send such notifications to you via email. You can withdraw your consent at any time by using the unsubscribe link in the email sent to you to unsubscribe or by sending us an email (daten@anyidea.ai) contact.

Intellectual property and usage rights

1. General allocation of rights through participation in campaigns

By participating in a campaign, users transfer, as far as is legally possible, exclusive, perpetual, factually, locally and temporally unlimited, transferable and sub-licensable right to use the content, including all rights to the title, description and any other items submitted as part of the campaign (hereinafter “Submissions”), to operators, including but not limited to the rights to patentable inventions. The right of use applies to all currently known and unknown types of use.

In particular, it comprises:

• promote or facilitate illegal activity,
• the storage of content on servers owned by operators or on servers by third parties commissioned by operators,
• their reproduction, processing, publication and distribution and, if applicable, making them publicly available through advertising on the platform (or parts of it) and websites operated by operators, in social networks and similar platforms,
• editing and reproduction, insofar as this is necessary for the provision or publication of the respective content,
• the right to commercialize, promote, distribute and sell all products containing the submissions worldwide.

By uploading content, users agree that contributions will be shared, linked and/or embedded.

These rights are transferred to AnyIdea customers after the campaign has ended. These property rights include design rights and rights to inventions worthy of patent.

By uploading content, user guarantees that he has all rights required for this use and for granting rights under these terms of participation (in particular copyrights), that there are no rights of third parties (intellectual property rights, industrial property rights, copyrights, trademark rights, patent rights, industrial property rights, trade secrets, data protection, personal rights) that preclude the aforementioned use of the submissions and that no further licenses, approvals, consents or Payments in Links with third-party intellectual property rights (including payments to collecting societies) are required so that operators can use the submissions as intended.

User must indemnify operators without restriction from all lawsuits, demands, costs, charges, losses, claims and expenses that operators incur as a result of the infringement or alleged infringement of third-party rights.

This right of use includes all types of use, including, for example, the right to copy, make available, publish, distribute via any medium, whether in physical or non-physical form, to exploit, translate, transform and/or change submissions. This right of use also includes the right to use submissions online and mobile on the Internet. Operators also have the right to commercialize, advertise, distribute and sell all products that contain submissions worldwide. The right of use should also grant operators the right to use parts of submissions, to change or redesign them or to have submissions from third parties changed or redesigned and/or to combine submissions with other submissions, which either come from operators, contracted companies or other users participating in the campaign or were purchased under license from third parties. The resulting works are considered submissions, which belong to operators and which are not subject to the declaration of consent from users or payment from operators to users.

The operators, as owners of the exclusive rights of use, have the sole right to claim infringement of the property rights arising from the submissions against third parties. The right of users to assert an infringement of property rights is excluded.

By participating, the user acknowledges that operators independently design templates or receive contributions that are similar or even identical to the submissions submitted by the user. User hereby waives the right to assert claims aimed at operators accepting, checking and/or using templates or contributions that are similar to those submitted by the user to operators. User expressly waives his right to be named as the author in connection with submissions.

Operators have the right, at their own discretion and discretion, to use inventions or protectable ideas contained in submitted submissions for technical purposes, to file a patent application and to register and assert further intellectual property rights in any country in their own name. This includes the right to maintain or relinquish such rights at any time. Property rights that arise as a result of such registration belong to operators. Should the registration of an intellectual property right require the cooperation of users who have submitted the submission, the user must support the operators by providing the necessary declarations, documents or other available documents.

All rights granted by User AnyIdea can be transferred to other affiliated companies and to AnyIdea customers.

2. Repatriation/Waiver of licenses for ideas that did not win

With the exception of entries that have won (see Section 1.), after the end of a campaign, operators will return any intellectual property rights previously transferred in Section 1 to users.

Operators will internally evaluate submissions that have not won on the feasibility of an implementation. Therefore, users should not transfer any ownership rights to third parties for a period of six months after the end of the campaign, i.e. any rights, titles, or interests of any nature that they have in submissions. Furthermore, no rights of use of the submissions should be awarded to third parties. During this time, users commit themselves to negotiations and discussions about a license transfer or the granting of a license operator.

3. Special rule for entries that have won

For the sake of clarity, it should be noted that Section 2 does not apply to ideas and submissions that have won.

Winners have no right to request that any part of their submission be implemented. Operators may transfer the rights of the submissions that have won to third parties. In addition, third parties may contact users after the competition.

Consent to publication/data protection

Users who participate in campaigns and submit ideas on the AnyIdea platform or other platforms operated by AnyIdea agree that:

• operators who may use submissions for PR purposes, including advertising
• the submissions are published on the Internet and are available there to an unlimited number of users,
• their name is mentioned in case of a win,
• They waive their rights or compensation in connection with the described handling.

Operators will only use personal data from users for purposes related to the campaign and submissions. When processed, personal data is subject to the data protection regulations of the Republic of Austria and the EU.

Data protection

AnyIdea takes the handling and protection of personal data very seriously. Details and information about data protection at AnyIdea can be found on the AnyIdea website under Data Protection and AnyIdea's general privacy policy (https://www.anyidea.ai/privacy-policy).

Disclaimer

Operator is not responsible for unreceived or misdirected submissions, whether due to a lost, delayed, or interrupted connection or other disruptions.

Operator is also not responsible for incorrect or incorrect submissions, regardless of whether they were posted by users or are due to system or program errors or human error in processing the submissions.

The majority of information posted on the AnyIdea platform comes from third parties. AnyIdea is not liable for this information provided by third parties. The person who created and/or submitted them is solely responsible for this. AnyIdea does not monitor and is not responsible for the information created by third parties.

Operator is not liable for the accuracy, reliability, completeness, usability or quality of the information or for the non-infringement of property rights by this information regardless of who provided this information. The user is aware that he bears the risk of relying on or using this information.

In addition, the AnyIdea platform and campaigns may contain links and references to third-party websites. AnyIdea is not responsible for the content of these websites and will not adopt these websites or the content as its own, as AnyIdea cannot exercise any control over the information and content posted there. Furthermore, AnyIdea is also not responsible for the quality, accuracy or completeness of the information provided and submitted by third parties.

Special conditions of participation

If a campaign includes special and individual participation conditions, these participation conditions are presented recognisably in the campaign.

Miscellaneous

It is the sole responsibility of the winner to pay taxes or other duties associated with the receipt of prizes. Acceptance of a win/prize in connection with a campaign is subject to applicable legal or regulatory requirements.

These conditions of participation, the implementation of campaigns and the interpretation and enforcement of participation conditions are subject exclusively to the law of the Republic of Austria, Austrian law.

Operator reserves the right to change these terms of participation at any time without prior notice and/or to interrupt, suspend or cancel campaigns without giving reasons and without assuming liability. The operator also has the right to exclude a user from participation at any time and without assuming liability if he does not comply with the conditions of participation.
